You Do NOT Need to Be Behind To File Bankruptcy!

What if you have, say, $12,000 in credit card debt, but you have never missed a payment? I have many clients that believe they can’t include a debt in bankruptcy if they are current on payments. You definitely can – and must(!!) - include these debts in your bankruptcy! This is great news, considering many of my clients are doing everything they can to stay current on their debt payments.

The fact of the matter is, you still owe the credit card company the total balance, not just the minimum. I.e. you have debt! The same is true for loans; you might be making the required payments, but your agreement states you owe the remaining balance, which means you have debt!

Thus, we can (and must) include these balances in your bankruptcy case. This is amazing, because it means your budget will clear up, and you will no longer have these debts hanging over your head!
