Gathering the Required Documents to File Bankruptcy: Very Easy

Filing Bankruptcy is much easier than most people imagine. With the incredible benefit of being able to eliminate all your debts, Bankruptcy is shockingly easy to file.

“Why?” - The reason the Bankruptcy Court requires the Documents:

-        Because the Bankruptcy Code is allowing you to eliminate all your debts without having to pay anything back (in many cases), the Bankruptcy Courts want to ensure all the rules are being followed; that the Bankruptcy Code is not being “abused” or “defrauded.” The required documents are a way for the Bankruptcy Court to verify the information being filed with the Court.

LIST of the Most Commonly Required Documents, and how to get them:

A)     Proof of Income: Very Easy

a.      Paystubs – very easy to gather: Either contact your payroll, or go online to access the paystubs

b.      Social Security Award Letter

c.      Pension Statement

d.      Child Support: Print-off from the ODJFS online portal

B)     Motor Vehicle Titles: Very Easy

a.      You probably already have the title. Whether it’s in a lock-box or in the glove compartment of your car

b.      Memorandum Titles (“White Title”): This is the type of title available if money is still owed on the car. You were probably sent a copy of the Memorandum Title about 3 weeks after you purchased the vehicle. If you don’t have it, you can get a replacement “Memorandum Title” at the BMV for $6.

C)     Tax Returns: Very Easy

a.      You probably have a copy of your tax return saved on your computer, or online with the company with whom you filed your taxes.

b.      If you don’t already have a copy, you can simply contact the tax-filing company and ask for a copy to be emailed to you.

D)     Credit Counseling Certificate: Very Easy

a.      Phone Call: Simply call the credit counseling company and speak with them for about an hour. At the end of the phone call, the company will issue you a Certificate that you completed the Credit Counseling!
