News Story from Long Island, NY: Bankruptcy Code Helps Delay Eviction for 23 Years

I want to preface this post by saying that I don’t condone abusing the bankruptcy code and the protections it imparts on the honest people that seek its protection & benefits. Abusers of the bankruptcy code get headlines, and these stories are often the only publicity given to bankruptcies, so these stories create a societal negative impression of bankruptcy that simply is not true for 99% of filers.  

That being said, there is a very interesting story out of Long Island, NY, that is worth reading if you remember 3 things:

  1. This story highlights the power of the bankruptcy code

  2. 99% of bankruptcy filers in real life file with honest intentions; this guy’s story is an anomaly

  3. This is an entertaining story

To summarize the wild story:

  • 1998: A guy in Long Island, NY, bought a house for $290,000

  • The 1st mortgage payment was made, then it was never paid again

  • 2000: The house was foreclosed upon, thus removing it from the guy’s ownership

  • 2000-2021: The guy continued to live in the house. He and his housemates filed 7+ bankruptcies - among other tactics – to remain in the house without paying rent.

  • 2021: After 23 years, the guy was finally evicted!!
